The estimated total value for one-time spot purchases is up to $25,000. for one time spot purchases up to $ 25, 000.

Failure to state delivery time obligates respondent to deliver in 14 calendar days. Time limits will be strictly construed and rigidly enforced.

The state will incur no penalty for late payment if payment is made in 30 or fewer days from receipt of goods or services and an uncontested invoice. Payment and remedies for late payment and nonpayment shall be made in accordance with the Texas Prompt Payment Act.

Manufacturers standard warranty shall apply unless otherwise stated in the IFB.

Evaluation of bids will begin as soon as practical after receipt. Evaluation adheres to the best value standard. The state reserves the right to make an award on the basis of low line-item offer, low total of line items, or in any other combination that will serve the best interest of the state of Texas.

Respondents must comply with all rules, regulations, and statutes relating to purchasing in the state of Texas. Each employee of respondent, including replacement employees, will possess the qualifications, education, training, experience and certifications necessary to perform the services.

In the event a successful respondent fails to perform services or complete the obligations under the contract in a timely manner, the state may require the respondent to pay, as liquidated damages and not as a penalty, an amount equivalent to 2% of the total cost for services or obligations not completed as required by the contract per calendar day of delay.

Samples, when requested, must be furnished free of expense to TJJD. If not destroyed in examination, they will be returned to the respondent, upon request, at respondent's expense.

Failure to sign the bid will disqualify the bid. Late and/or unsigned bids will not be considered. Copyrighted bids are unacceptable and are subject to disqualification as nonresponsive.

The delivery of the vehicle shall be no later than two hundred and ten (210) calendar days after the date of the award.

Payment shall be made for items accepted by the government that have been delivered to the delivery destinations set forth in this contract. The government will make payment in accordance with the prompt payment act 31 **** and prompt payment regulations at 5 CFR part ****.

European warranty terms and conditions shall apply for the vehicle.

Award will be made to the lowest priced, acceptable, responsible offeror. Evaluation factors will include, vehicle price, fuel costs, maintenance costs, and possible fleet commonality to determine the best option to benefit the government.

Offerors shall be registered in the SAM system for award management database at www. ***. *. * prior to submittal of their offer/proposal. Offerors must also provide evidence of an established business with a permanent address and telephone listing in France (KBIS or equivalent), proof of SAM registration, list of clients over the past three years, evidence of necessary personnel, equipment, and financial resources, and copies of licenses and permits required by local law.

The government may terminate this contract, or any part hereof, for cause in the event of any default by the contractor, or if the contractor fails to comply with any contract terms and conditions, or fails to provide the government, upon request, with adequate assurances of future performance.

Failure to be registered in the SAM system at the time of proposal submission may deem the offeror's proposal to be considered non-responsible and no further consideration will be given.
