The successful bid will be selected based on the following evaluated elements: 1 Proposed price (75 points) and 2 Ability of offeror to develop the building in a manner that provides retail space, services, adds or develops employment and/or generates city sales tax (25 points).

An acceptable bid is one received from a responsible bidder, whose bid, conforming to this IFB, will be most advantageous to the city. The offeror certifies that the submission of the offer did not involve collusion or other anti-competitive practices.

In the event of a revocation of a bid prior to acceptance by the city, or after notice of acceptance, or any default by the purchaser in the performance of the contract of sale, or failure by the purchaser to consummate the transaction, the purchaser agrees that any earnest money and all deposits paid to the city are subject to forfeit by the purchaser to the city as damages for breach of contract.

All claims and controversies shall be subject to resolution according to the terms of the City of Douglas Procurement Code.

An offeror including each of its principals who is currently debarred, suspended or otherwise lawfully prohibited from any public procurement activity may have its bid rejected. Failure to sign the offer, or signing it with a false statement, shall void the submitted offer or any resulting contracts, and the offeror may be debarred.
