The State will pay the contractor based on the payment methodology outlined in Section C. 3 of the pro forma contract, which includes implementation charges, yearly subscription charges, and user license fees. Payments are contingent upon satisfactory provision of goods or services and are typically made after acceptance or in advance as specified.
The contractor warrants that the goods or services provided will conform to the contract terms throughout the warranty period, which is the greater of the contract term or any other warranty generally offered by the contractor, its suppliers, or manufacturers. If nonconformance is found, the contractor shall correct the defect at no additional charge.
The contract will be awarded to the respondent deemed responsive and responsible who offers the best combination of attributes based on the evaluation criteria, which include general qualifications and experience, technical qualifications, experience and approach, oral presentations, and cost proposal.
Respondents must meet general qualifications and experience requirements, including detailing their business form, years in business, number of employees, client base, and providing statements regarding conflicts of interest, prior convictions, bankruptcy, and pending litigation. Specific technical qualifications and experience related to the CIMS solution are also required.
The RFP does not explicitly detail specific monetary penalties for contract breaches.
