The base year of performance is from 06/01/2026 to 05/31/2027. Option years extend through 05/31/2031. Services will be provided two days per week for a total of 40 weeks.

Payment will be made within 15 days in arrears upon delivery of goods/services, after inspection, acceptance, and receipt of a proper invoice. Invoices shall be submitted electronically through the U. S. Department of the Treasury's Internet Payment Platform System (IPP).

Quotes will be evaluated based on experience, capability, key personnel, and price, with the award going to the responsible contractor whose quote is most advantageous to the government.

Key personnel must have a Doctorate degree in Physical Therapy from an accredited program, successful completion of the National Physical Therapy Examination (NPTE), a current and valid physical therapist license in North Dakota, and a minimum of five years of professional experience, preferably in a school-based setting, with demonstrated experience working with students with special needs and developing IEPs.

The contractor shall be found in breach of contract, which shall be grounds for contract termination if unauthorized staff are found onsite without approved security clearances. Providing partial or incomplete data during the investigation process may be considered failure to cooperate, and the contractor shall be removed should unnecessary delays occur.

Individuals with certain criminal convictions, including crimes of violence, sexual offenses, crimes against persons, or offenses committed against children, may be disqualified. Other factors include misconduct, dishonest conduct, intentional false statements, refusal to cooperate with an investigation, alcohol or substance abuse, illegal drug use, and engaging in activities to disrupt government programs.

The deadline for submission of solicitation responses is August 4, 2026, at 2:00 p. m. CT. Construction must be substantially completed within the time period proposed by the contractor, with an estimated construction time of approximately 30 calendar days after receipt of a notice to proceed.

All project deliverables must be accepted by the ODR prior to approval of contractors requests for payment. Specific payment terms are detailed in the sample contract (Exhibit B).

The award will be made to the respondent that provides the best value to the state of Texas, based on cost (40%), demonstrated relevant experience, qualifications and past performance (25%), technical proposal (25%), overall responsiveness, clarity, and organization (5%), and safety record, quality control program and cost controls (5%).

Respondents must have at least three years of experience in the coastal construction business or equivalent management experience, demonstrated experience in meeting completion dates and construction schedules, and demonstrated experience in excavation, hauling, and placement of fill in shallow water environments for projects of similar scope and size completed in the last three years.

If the contractor fails to achieve substantial completion within the contract time, the contractor shall be liable for liquidated damages of **** per day until substantial completion is achieved.

Respondents are strongly encouraged to visit the site and assess the work to be performed before submitting a proposal.

Any respondent unsuccessful or aggrieved in connection with this solicitation may file a protest in accordance with title 31, section 3. 50 of the Texas Administrative Code.

Failure to observe the restriction on prohibited communications may disqualify the respondent. Submitting a solicitation response with a false statement or making a material misrepresentation during contract performance is a material breach and may void the response and contract. Failure to submit a VETHUB subcontracting plan will result in rejection.

The approximate cost range for construction of the project is $450,**** to $500,****.

Responses to this IFB must be received July 7, 2026, 10:30 AM Central Time.

HHS System Agency will make contract payments in accordance with chapter **** of the Texas Government Code, the Texas Prompt Payment Act. Invoices must include the contract or purchase order number and describe the work completed in detail.

Award will be made to the bidder who provides the best value to the state of Texas, based on meeting or exceeding requirements, ability to meet performance delivery requirements, and price.

Bidders must have relevant experience of at least five years. Personnel assigned must be fully trained and have at least five years of relevant experience. Registered Art Therapist (ATR) or Provisional Registered Art Therapist (ATR-Provisional) is required.

Failure to comply with sole point of contact requirements, submitting exceptions to the IFB, including assumptions in a response, or failing to monitor the ESBD for addenda may result in disqualification.
