Suppliers must be registered in EVA if the local public body is accepting electronic and paper responses, awarding to a supplier that has submitted a paper response, or posting award actions in EVA. There is no cost for EVA registration. Contractors must be authorized to transact business in the Commonwealth. Bidders must submit evidence of practical knowledge of the work and financial resources. Irregular proposals, those on forms other than the city's, with unauthorized additions, or lacking the proposal guaranty, will be rejected. Bidders may withdraw proposals due to clerical mistakes, provided notice is given within two business days. Bidders submitting multiple proposals from the same entity or exhibiting collusion will be disqualified. All formal proposals are binding for 90 calendar days. The contractor is responsible for cleanup at the completion of the work. The project manager's decisions are final. Contractors must have at least one staff member on-site fluent in English. Professional and workmanlike behavior is required. Contractors must provide a statement and list of employees, certifying that employees have not been convicted of a felony in the past 7 years, can qualify for voting rights reinstatement, and are not on active parole or active probation. Certain items of work may be performed by city forces. The city may award contracts to others for other work. The contractor shall remedy any defects in the work within one year of final acceptance. Equal employment opportunity and drug-free workplace clauses are included. Materials and work must comply with the requirements of the plans and specifications. Defective work must be repaired within 30 days. The contractor shall indemnify the city against claims arising from the contract. Insurance requirements are detailed. Bidders must submit a written request for interpretation of any part of the RFP at least four days before the proposal deadline. The contractor shall be limited to a specific area for storage. Assignments or novations of the contract require written consent. The contractor must comply with all federal, state, and city laws. The contractor agrees to indemnify the city for the use of patented appliances. The city may procure the commodity or services from other sources in case of default. The contractor must secure any business or professional licenses, permits, or fees required by the city. Construction site safety is the contractor's responsibility. When brand names, model numbers, trade names, catalog numbers, or cuts are listed, bidders may offer an equal article. No proposed subcontractor shall be disapproved by the city except for cause. The contractor is responsible for the acts and omissions of subcontractors. Payments to subcontractors must be made within seven days. The work may be suspended by the city when deemed in the best interest of the city. If the contractor fails to begin or perform the work satisfactorily, the city may terminate the contract. The city reserves the right to reject any or all proposals or waive any defects. All quantities are estimates only. The proposal is subject to acceptance within 90 days. Operator qualification records, current OQ certifications, welding procedure specifications, and safety training records are required. Previous jobs completed within the past five years, references, and a detailed list of rates/pricing are required.
The contractor guarantees that all materials and work comply with plans and specifications. All expenses for defective equipment or merchandise are the contractor's responsibility. Defects in completed work must be repaired within 24 months of acceptance, unless otherwise specified.
Proposals will be evaluated on qualifications (50%), prior experience (35%), references (10%), and price (5%).
Bidders must submit evidence that they have practical knowledge of the particular work bid upon and that they have the financial resources to complete the proposed work. Failure to carry out previous contracts satisfactorily, or lack of experience or equipment necessary for the satisfactory and timely completion of this project, may be deemed sufficient cause for disqualification of said bidder.
If the contractor fails to clean up at the completion of the work, the city may do so and the cost thereof shall be charged to the contractor. In case of default, the city may procure the commodity or services from other sources and hold the contractor responsible for any excess costs occasioned thereby.
